About this course

The release of information process can become more complicated and involve more emotions when an authorization or third-party directive is completed by a "personal representative" like a healthcare power of attorney or guardian. HIM professionals are charged with maintaining confidentiality without impeding access in these highly sensitive situations. This enlightening session will cover the most common types of personal representatives under the HIPAA Privacy Rule and the various state statutes. We will also analyze sample documents as well as techniques you can use to avoid pain points associated with each personal representative type. AHIMA Core Educational Content Areas: Information Protection, Access, Disclosure, Archival, Privacy and Security.

Learning Objectives

  • Define the Office for Civil Rights (OCR) role in ensuring patient access to their PHI.
  • Explain the difference between a patient-directed request (PDR) and other authorization types.
  • Discuss the potential benefits and challenges of using PDRs.
  • Describe the organizational changes effective in sustaining direct and easy patient access to their PHI.

Course Instructor(s)

  • Elizabeth McElhiney, MHA, CHPS, CPHIMS, CRIS

    As Director of Compliance and Government Affairs, Ms. McElhiney is responsible for the administration of Verisma's privacy and compliance programs, working with clients to implement evidence-based best practices, and overseeing Verisma’s thought leadership initiatives. Ms. McElhiney has worked in Health Information Management and Release of Information for over 14 years; covering all areas of the industry from customer service to compliance. She currently sits on the Illinois Health Information Management Association (ILHIMA) Board of Directors and serves as a delegate to the American Health Information Management Association (AHIMA) House of Delegates. In addition, she is the current Secretary and CRIS Chairperson at the Association of Health Information Outsourcing Solutions (AHIOS). Ms. McElhiney also holds a Bachelor of Arts in Political Science from Illinois Wesleyan University and a master’s degree in health administration with a specialization in Health Informatics from Capella University.

  • Darin Challacombe, Ph.D, SHRM-CP

    Dr. Darin Challacombe is a researcher, author, professor, and education professional. He is Verisma’s Director of Learning and Employee Development, and as a member of the Human Resources team, he oversees all educational opportunities for the company. He has worked in educational space since 2002. Mr. Challacombe has a Ph.D. in Social Psychology and is on the adjunct faculty team for Fort Hays State University. Prior to Verisma, Mr. Challacombe worked as a grant-writer for a Kansas-based non-profit organization and for the Department of Justice. He serves as the treasurer for the Association of Health Information Outsourcing Services (AHIOS) and as secretary for Global Ties Kansas City, a not-for-profit organization connecting the USA to the world. He is also Associate Editor for the Behavioral Sciences of Terrorism and Political Aggression journal.
